Bankruptcy lawyers are often saddled with several cases. They need to file forms, handle inquiries, and prepare petitions for different clients. They get so overworked which increases the chances of missing an important detail or a problem in the proceedings. Bankruptcy assistance companies see this as an opening to have stable clients and a wide market. Before debtors worry about their files sitting on someone else's financial help desk other than that of their lawyers, these companies are certified by the lawyers association. Their staff also have to undergo specific training before becoming bankruptcy assistants.

Borrowers are given a choice of which rate to pay, which is why negative amortization loans are also referred to as "payment option" loans and option ARMs. Cost of Funds Index (COFI), Cost of Savings Index (COSI), and Monthly Treasury Average (MTA or MAT) are all examples of Alt-A negative amortization loans. The Mortgage Bankers Association of America (MBA) says alt-A loans' share rose from 8% to 11%. Why? Because of the flexibility these loans offer, not to mention affordability for a home purchase loan or if you want to cash out on your home equity with a mortgage refinance.

It's often said that there are two things we can depend on in life: death and taxes. The former will certainly remove all worry about the latter, but until it happens, you have to pay taxes. In the example above, many people would go ahead and send in the $1000 by the first quarter deadline in order to avoid the penalty. The rules encourage them to do this, but by doing so, they are cheating themselves and the government out of money. If the estimated tax requirement for capital gains were abolished, the man in my illustration would end up keeping an additional $97.50 ($150 - $52.50) and the government would get an additional $52 in tax revenue by letting him hold on to his money longer. In addition, the rules associated with estimated taxes are way too complicated and cause major inconveniences for taxpayers and IRS employees alike.

Here's an illustration of what I mean. Let's say a man in the 35% tax bracket incurred a $1000 tax bill in the first quarter on an investment that earns him 20% a year. He could go ahead and send that money in to the IRS by the first quarter deadline to avoid a 5% penalty for the final three quarters of the year. This penalty would be $37.50 ($1000 x .05 x .75). Or he could go ahead and keep that money drawing the 20% for the last three quarters ($1000 x .20 x .75) for a total of $150. Of course, he would have to pay the $37.50 penalty when he files and the taxes on his additional $150 gains would be $52.50. That would still leave him with $60 ($150 - $37.50 - 52.50) that he wouldn't have had by just paying the estimated taxes. Even if there is a subsequent penalty on the $150 totaling $5.63 ($150 x .05 x .75), he would still be left with $54.37.

Learn that cash is your best friend. Make a deal with yourself. You can only pay in cash. Once you run out of cash, that's it until the next pay day.

Negative amortization and interest-only loans can be useful if you are primarily concerned with cash flow instead of building equity. If you only pay the payment rate, the overall monthly mortgage payment might be lower than a typical 30-year, amortization loan. You might want to consider a negative amortization or interest only mortgage if you're a short-term borrower who plans to refinance or sell the home within a period of a few years or if you have unsteady sources of income or too little documented income to qualify for a traditional loan.

Why doesn't everyone just call bankruptcy when everything gets too hard. Put simply, your credit is ruined. For a long time after the bankruptcy verdict, your bad credit follows you around like an enthusiastic dark cloud. Every time you file for a loan, your credit report pops up consolidate debt and most lenders won't look twice at you. Even when a creditor eventually offers you a loan, you can expect to pay pretty high rates indeed. Some bankrupts have to take out a second loan to cover the down payment on the initial loan. How scary is that?

Another point of distinction is the low rate of interest. Suppose you owe some amount on credit cards. Very soon, you can expect the amount to double, or at worse triple. Don’t you believe me? Just check the interest rates that credit card companies are offering funds at. If the same debts are intended to be eliminated through a debt consolidation loan, the debtor will largely benefit. Firstly, he will get funds at a much lower rate. Secondly, as funds are arranged fast, the debtor can instantly pay up the credit card company. Therefore, more increase in debt is curbed.
